Dinner with KSI & Randolph Prize Draw Terms and Conditions
These terms and conditions ("the Terms") set out important information regarding your rights, obligations and the restrictions that apply to the “Dinner with KSI & Randolph” prize draw (“the Prize Draw”) by purchasing a valid ticket to KSI & Randolph’s New Age Tour 2019 . By participating in the Prize Draw, entrants agree to be bound by the Terms.
The promoter of the Prize Draw is Endemol Shine UK Ltd T/A Cut and Mustard at The Shepherds Building Central, Charecroft Way, Shepherds Bush, London W14 0EE (“C&M” or ”We”).
Details of the Prize Draw are displayed on Cut & Mustard’s website http://www.cutandmustard.com/on either the web ("Prize Draw Notice") and are incorporated into the Terms. In the event of differences between these Terms and the Prize Draw Notice, these Terms shall prevail.
There will be two (2) winners who will each be entitled to bring along two (2) friends or family members to a dinner with KSI & Randolph. The first with be on 7th June 2019 and the second will be on 17th June 2019 at locations in the UK of your choosing (subject to availability on that date) to be confirmed to the winners at least 48 hours in advance (each a “Prize Experience”). Each Prize Experience will consist of dinner (or lunch if mutually agreed) up to a total of five hundred pounds (£500) with accommodation for one (1) night and travel from your home to the restaurant provided by the Promoter, travel and accommodation is to be selected and provided at the Promoter’s discretion. Each Prize Experience may be filmed for initial inclusion on KSI’s digital platforms.
C&M reserves the right to cancel or amend the Prize Draw or the Terms at its sole discretion and without notice in the event of any event outside C&M's reasonable control. Any changes will be an amendment to these Terms or to the Prize Draw Notice.
In the event of any dispute regarding the Terms, conduct, results and all other matters relating to the Prize Draw, the decision of C&M shall be final and no correspondence or discussion shall be entered into.
Qualifying Entrants
All entrants must currently reside in the United Kingdom (excluding Northern Ireland) and in the event of winning the Prize Draw the winner must pay for his/her own food and accommodation with the exception of the meal with KSI & Randolph and accommodation as specified above.
All entrants must have already purchased a valid ticket for at least one show of KSI & Randolph’s New Age Tour 2019 and must provide proof of purchase and proof residence if selected as the winner. Under 18s must be escorted by a parent or guardian.
Entrants must have purchased a valid ticket prior to entering the Prize Draw. Any entries made prior to purchasing a ticket will be deemed invalid.
Employees (or members of the families or households of employees) of C&M or any company involved in the Prize Draw including, if relevant, of any advertising agency or website development company connected with the Prize Draw or any subsidiary or associated companies of the same, are not eligible to enter the Prize Draw. C&M reserves the right not to award either Prize Experience (and to select an alternative winner) if C&M is aware or has reasonable grounds to suspect that a winner is not eligible for these reasons.
By entering the Prize Draw, you hereby warrant that all information submitted by you is true, current and complete. C&M reserves the right to verify the eligibility of all entrants and disqualify an entrant for submitting false information.
The information you provide with your Prize Draw entry will be used in respect of prize fulfilment so please make sure this is correct. The Prize Draw is only open to those with internet or mobile application access and a valid ticket to the New Age Tour 2019.
The winners hereby irrevocably consent to the photography, filming, recording and/or live relay of themselves at each Prize Experience for use on KSI & Randolph’s digital platforms (the nature and content of which has been fully explained to the winners) and the inclusion of the winners’ contribution at each Prize Experience and upon request will sign a release form at each Prize Experience. The winners accept that C&M is not required to incorporate any of their contribution into the final version of any content posted on KSI & Randolph’s digital platforms. C&M reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant is not eligible or has otherwise breached any of the Terms.
In the event that a Prize Draw winner is subsequently disqualified from the Prize Draw for any reason, C&M, in its sole discretion, may decide whether a replacement winner should be selected in accordance with the Prize Draw criteria.
Prize Draw Entries
You may only enter the Prize Draw once and a maximum of one entry per ticket. Multiple entries per ticket holder will be counted as one entry with the first entry submitted being the entry counted. Where C&M discovers or has reasonable grounds to suspect that any entrant has used any software or automated process to enter the Prize Draw or to make bulk entries, C&M may exclude such entries and disqualify the entrant from the Prize Draw.
To become eligible to win either Prize Experience you must have purchased a valid ticket during the period expiring at 6pm on Tuesday 21st May 2019 the Submission Period”). All tickets purchased within the Submission Period will be entered into the Prize Draw.
The winning entrants from all eligible entries will be selected at random within five (5) days of the end of the Submission Period. The winning entrant will be selected by a computer process that produces verifiably random results.
There is no minimum or maximum number of entrants for the Prize Draw. Entrants agree that if selected as the winning entrants they will be notified by C&M and when contacted by C&M agree to supply their name and relevant details for the purposes of prize fulfilment. Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winning entrant.
If C&M is unable to contact the winning entrant using the contact phone number or email address provided within twenty four (24) hours of C&M’s initial attempt to contact the winning entrant we may disqualify such entrant and select another winning entrant. Claims for either Prize Experience must be made in the manner and within the time specified in these Terms.
C&M reserves the right, where necessary to undertake all such action as is reasonable to protect itself against fraudulent or invalid entries including without limitation to require further verification as to the identity, age, consent or other relevant details of the entrants. Where no such written proof is supplied, or the entrant does not meet the eligibility criteria, C&M may disqualify the entrant.
Prize Draw entries must be made in the manner and during the Submission Period as set out above. Failure to do so will disqualify the entry. We reserve the right to reject and or disqualify any entry in our sole discretion including without limitation for a breach of these Terms.
C&M cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to entries, or entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside C&M's control.
The winner will be eligible for the Prize Experiences which are due to take place at a location time and date to be confirmed to the winner at least 48 hours in advance.
The Prize Experiences shall be awarded at C&M's discretion and C&M reserves the right to amend, cancel or modify any aspects of either Prize Experience due to circumstances for any reason whatsoever. In such circumstances C&M may in its sole discretion award an alternative prize of equal or greater value at any time.
The Prize Experiences carry no cash value, are non-transferable and may not be substituted by the winners. There is no cash alternative for either Prize Experience and no compensation will be payable if either winner is unable to take the Prize Experience as stated. If the winner is unable to take their Prize Experience within the stated period, C&M reserves the right to offer their Prize Experience to the entrant who is placed second in the Prize Draw (or if they are also unable to take the Prize Experience, the next available entrant).
Entrants acknowledge and agree that the winning entrant shall not under any circumstances whatsoever sell or transfer their Prize Experience or any part thereof to any other person(s). C&M reserves the right to cancel either Prize Experience if it has reasonable grounds to believe an entrant has sold transferred or exchanged or has attempted to sell transfer or exchange the Price Experience.
In the event you are a winner you undertake that you shall not unless authorised in writing by the C&M at any time hereafter make any statement or disclosure or supply any information or photographs to any person firm or corporate body or to the public relating to the Prize Draw or to any matter arising hereunder including but not limited to announcing the result of the Prize Draw on any media whatsoever.
The winners will be asked to confirm that they will not post on social media platforms portraying C&M or either Prize Experience in a negative, disparaging or unsavoury manner (as determined by C&M). If there are any issues with either Prize Experience or any aspects of either Prize Experience these should be brought to the attention of C&M’s representative for resolution. Any individuals seen to be contravening this may be disqualified from the Prize Draw and/or their entitlement to either Prize Experience may be forfeited.
By accepting the Prize Experience, each winner agrees to adhere to reasonable instructions from C&M’s representatives, these will include that each winner enjoys the Prize Experience responsibly and conduct themselves appropriately and in a manner that does not threaten to bring the Prize Draw or C&M into disrepute or otherwise harm or damage the reputation of the same. Any repeated failure of either winner to comply with the C&M representatives’ reasonable instructions, including any behaviour warnings may lead to aspects of the Prize Experience being cancelled or forfeited.
C&M accepts no liability for any failure to perform their obligations arising from internet connectivity issues, force majeure, labour disputes, strikes or lock outs or any other cause beyond the control of C&M or the carrier.
Your entry and any information submitted by you must be personal to and relate specifically to you. You warrant that your entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. In addition, you warrant that you have permission to use or feature any people, content or other material contained within your entry. C&M reserves the right to screen, filter and/or monitor entries for this purpose.
C&M cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Prize Draw or as a result of accepting the Prize Experience. C&M is not responsible for any technical issues in relation to any telecommunications or internet network (including in relation to speed or bandwidth), including any injury or damage to entrant's or any other person's device related to or resulting from participation or downloading any materials in the Prize Draw. Nothing shall exclude C&M's liability for death or personal injury as a result of its negligence.
The winners may be requested to take part in post event promotional activity and C&M reserves the right to use the names and contact details of the winners, their photographs and audio and/or visual recordings of the winners in any publicity. Entrants acknowledge and agree that the winners are expected to appear on C&M’s digital channels and that if the winner agrees the winner will enter into a release with C&M for such contribution to enable C&M to exploit such contribution worldwide in all media perpetuity.
Entrants agree that by entering the Prize Draw their personal details will be stored and otherwise processed by us for the purposes of administering the Prize Draw and prize fulfilment. Data relating to entrants will be retained by C&M for a reasonable period after the Prize Draw closes to assist C&M to operate the Prize Draw in a consistent manner and to deal with any queries. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation.
Any dispute or claim arising out of or in connection with the Prize Draw shall be governed by and construed in accordance with English law and entrants irrevocably agree that the Courts of England shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Prize Draw.
The Prize Draw is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to C&M and not to Facebook and that Facebook has no liability for any element of this Prize Draw.
By participating in this Prize Draw, to the extent permissible by law, you, the entrant, hereby release Facebook from any and all claims, damages or liabilities arising from or relating to your participation in the Prize Draw.
The Prize Draw is in no way sponsored, endorsed or administered by, or associated with Twitter. You understand that you are providing your information to C&M and not to Twitter and that Twitter has no liability for any element of this Prize Draw.
By participating in this Prize Draw, to the extent permissible by law, you, the entrant, hereby release Twitter from any and all claims, damages or liabilities arising from or relating to your participation in the Prize Draw.
The Prize Draw is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to C&M and not to Instagram and that Instagram has no liability for any element of this Prize Draw.
By participating in this Prize Draw, to the extent permissible by law, you, the entrant, hereby release Instagram from any and all claims, damages or liabilities arising from or relating to your participation in the Prize Draw.
Privacy Policy
C&M is a data controller in respect of your personal data related to the Prize Draw. C&M has a Contributor and Talent Privacy Policy http://www.endemolshineuk.com/contributor-talent-privacy-notice/ which sets out how we collect, store, use and disclose your personal data. You confirm that you have read the Contributor and Talent Privacy Policy and you understand how we collect, store, use and disclose your personal data. C&M wishes to ensure that the information we hold remains as accurate as possible and may therefore require you to update your personal data at any time. You shall in any event inform the C&M of any changes to your personal data and may review and update the data on reasonable notice to C&M.
